The Residential Tenancies Amendment Act 2024 (RTAA 2024) introduces several critical updates to New Zealand tenancy laws, implemented progressively throughout 2025. Significant changes effective immediately include a shift to mandatory online bond lodgments, with manual submissions no longer accepted, and strengthened protections for tenants against retaliatory termination notices. As of 30 January 2025, landlords gained the ability to end periodic tenancies with 90 days’ notice without providing a specific reason, or 42 days’ notice in specific cases such as the owner moving back in or the property being sold. Furthermore, fixed-term tenancies can now be terminated at their expiry by either party with 21 to 90 days’ notice.
Additional updates effective 20 March 2025 permit the use of email for formal notices, allow landlords to legally ban indoor smoking, and expand family violence withdrawal provisions to include cases involving a tenant’s children or dependents. Later in 2025, new regulations will require landlords to have reasonable grounds to refuse a pet request, while also allowing them to charge a pet bond of up to two weeks’ rent. Tenants will remain fully liable for any pet-related damage beyond fair wear and tear.
